Associations and MLS offices across the country are having the same discussion right now.

At the National Association of REALTORS®' NXT Conference in November 2025, the association voted to repeal its longstanding policy requiring REALTOR® membership as a prerequisite for MLS access, declaring that MLS access is now a matter of local discretion. The 18-policy update to the MLS Handbook — the most extensive in two decades — effectively returns decision-making authority to local MLSs on issues including non-member access, private listings, and disciplinary standards.

Some MLS leaders see this as positive modernization; others are warning that the business and legal responsibility now falls squarely on local associations and their MLS partners to chart the right path forward.

That path is ours to define here in Vail.

How VBR and the Vail MLS respond to this shift will have real consequences — for our governing documents, our Rules & Regulations, our membership model, and for every agent and broker who depends on the MLS as a core business tool.
